Game Period: The Race Out a Winner Game (the "Game") begins on March 1, 2008, at 12:01 a.m. Central Time ("CT") and is scheduled to end April 30, 2008, at 11:59 p.m. CT (the "Game Period").
- How to Play: During the Game Period, you can obtain a game code in 3 ways: 1) Make any purchase at any participating Exxon or Mobil station or On the Run convenience store (excluding the purchase of alcohol, tobacco and lottery tickets) and receive a Hero Card containing a unique game code, while supplies last. Limit one (1) Hero Card per day per customer. 2) To obtain one (1) free game code without purchase, mail a 3" x 5" card or piece of paper hand-printed with your complete name, address, city, state, zip code, date of birth and valid e-mail address in an envelope with proper postage affixed to: Race Out a Winner Game Piece Request, P.O. Box 282, Wilton, CT 06897-0282. All mail-in game piece requests must be postmarked by April 16, 2008. Limit one request for one (1) free game code per stamped outer envelope per day. Game codes will be sent to the e-mail address listed on the request. 3) From April 17, 2008 to April 30, 2008, to obtain free game code call toll-free 1-888-492-0800 and follow the instructions provided to obtain one (1) eight-digit alphanumeric game code. Limit one request for one (1) free game code per call per day. Requests via this method must be received by 11:59 p.m. CT on April 30, 2008. To play, access www.raceoutawinner.com, complete the official registration form and follow the on-screen instructions. You will be prompted to enter your eight-digit alphanumeric game code and hit "submit." If you are the first person to play the game at a randomly pre-determined winning moment, as determined by Sponsor, or immediately following such moment if no one plays the game at such exact moment, you will be an Instant Win Prize winner, subject to verification of eligibility, game code and compliance with the terms of these Official Rules. All game plays must be received by 11:59 p.m. CT on April 30, 2008. Limit one (1) game play per person, per unique code and per e-mail address per day. Each time you play, you will also be entered into the Grand Prize Drawing (as described below).
- Prizes/Approximate Retail Value/Odds of Winning: Ten Grand Prizes will be awarded to ten different winners. Each Grand prize consists of a 3 day, 2 night trip for winner and one (1) guest to a race. Includes round-trip air transportation from major U.S. gateway airport nearest winner's residence (as determined by Sponsor) to race location for winner and one guest, two nights hotel accommodations (one standard room, double occupancy), two tickets to the race; Race day grandstand access, Fully catered private Mobil 1 hospitality chalet access, Closed circuit TV access, two Event programs, Pre-race pit tours - (pending limited access and availability), Driver appearance, Mobil 1 showcar access and two Specialty Mobil 1 branded trackpacks and a 2 day mid-size car rental. Car rental subject to winner and/or trip participant holding a valid U.S. driver's license and qualifying as an eligible driver under applicable car rental company policy (including the attainment of age 25) and other rental car company terms and conditions. Car rental does not include gas, tolls, parking fees, collision waiver insurance, or any other related fees and is subject to car rental company terms and conditions. $200 spending money for winner only will be provided. (Approximate Retail Value ("ARV"): $3,330). Actual value may vary based on point of departure. Winner must be able to travel on dates specified by Sponsor in 2008 or prize will be forfeited and Sponsor will have no further obligation to such winner and, at Sponsor's discretion, an alternate winner may be chosen, time permitting. If winner resides within a 100 mile radius of race, Sponsor reserves the right to provide ground transportation in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Travel arrangements must be made through Sponsor's agent, on a carrier of Sponsor's choice, at least 21 days prior to travel. Winner and travel companion must travel together on the same itinerary and are responsible for obtaining all travel documents required by airline. Grand Prize travel companion must be of the legal age of majority in his/her state of residence (and at least 18 years of age) and must execute and return a liability/publicity release prior to issuance of travel documents. If travel companion is a minor, such release must be executed by his/her parent or legal guardian. Certain travel restrictions may apply. Airfare and hotel accommodations are subject to availability. All other costs and expenses associated with the acceptance and use of the prize not included in the prize description above as being provided (including, but not limited to, taxes, fees, additional ground transportation and meals, gratuities and tips) will be the sole responsibility of the winner. In the event race is cancelled for any reason, no compensation or substitution will be provided for any portion involving the race track; however the remainder of the prize package will be awarded and Sponsor will have not further obligation to winner. All prize details are at the sole discretion of the Sponsor. Location of seats are at Sponsor's sole discretion. Winner and travel companion must comply with all venue and service provided rules and regulations. Failure to do so may result in forfeiture of such prize element. Instant Win Prizes: Four (4) First Prizes: Either a Ryan Newman or Sam Hornish, Jr. autographed Helmet (Sponsor's choice) (ARV: $975 each). ARV is subject to fluctuation based on the current market value at time of prize award. Helmet is not race used and not suitable for racing. 30 Second Prizes: 1:24 scale Diecast Car (ARV: $27 each); 1,000 Third Prizes: Baseball cap (ARV: $5 each); 1,000 Fourth Prizes: Mouse pad (ARV: $5 each); and 1,000 Fifth Prizes: 1:64 scale Diecast Car (ARV: $5 each). Total ARV of all prizes: $53,010. Odds of winning an Instant Win Prize are based on the number and timing of game plays on website. No substitution, cash equivalent or transfer of prizes (or portion thereof) permitted by winners. Sponsor reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. All federal, state and local taxes, and all costs and expenses related to the acceptance and use of the prizes not specified in these Official Rules as being awarded are the sole responsibility of the winners. Prizes will be awarded "as is" with no warranty or guarantee, either expressed or implied by Sponsor. Limit one First - Fifth Prize per household per person per e-mail address. Unclaimed First - Fifth prizes will not be awarded.
- Instant Win Prize Redemption and Notification: All potential Instant Win Prize winners will receive an immediate prize notification following a winning game play. Second through Fifth Instant Win Prizes will be sent via U.S. mail to the mailing address provided upon registration within six to eight weeks following verification of winning game play, eligibility and compliance with the terms of these rules. P.O. Boxes will not be accepted. Potential First Prize winners will be required to execute and return an affidavit of eligibility, a liability release and, where legal, a publicity release, within 14 days of date of issuance or prize may be forfeited. If prize or prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner within a reasonable time period or in the event of noncompliance with these Official Rules, prize may be forfeited. First prize will be shipped via Federal Express within six to eight weeks following winner verification.
- Grand Prize Drawing: Ten (10) potential Grand Prize winners will be randomly selected on or about May 7, 2008, from among all eligible game plays received during the Game Period, by an independent judging agency, whose decisions are final and binding. Odds of winning the Grand Prize will depend on number of eligible game plays received for the entire Game Period. Potential Grand Prize winners will be notified via overnight mail and/or phone and will be required to execute and return an affidavit of eligibility, a liability release and, where legal, a publicity release, as well as any other documents that may be required by Sponsor and/or prize suppliers within 14 days of date of issuance or prize may be forfeited and, at Sponsor's discretion, awarded to an alternate winner. If prize notification is returned as undeliverable or in the event of noncompliance with these Official Rules or if Sponsor is unable to contact potential Grand Prize winner within a reasonable time period, prize may be forfeited and, at Sponsor's discretion, awarded to an alternate winner. Limit one Grand prize per household per person per e-mail address.
- Eligibility: Game is open to legal residents of, and currently residing within, the continental U.S. (excluding residents of Alaska, Delaware, Hawaii, Maryland, New Jersey and Virginia - Delaware, Maryland, New Jersey and Virginia have laws or regulations relating to promotions conducted in conjunction with the retail motor fuel industry. Residents of those states are prohibited from participating in this promotion by law). The participants of this promotion must be of legal age of majority in his/her state of residence, (and at least 18 years of age), with internet access and who have a valid e-mail address at time of entry. Employees of Exxon Mobil Corporation ("Sponsor"), Marketing Drive, LLC, PSG, Rivet, participating sponsors, and their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising and promotional agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this Game, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in the same household of each such employee, whether or not related, are not eligible to enter or win prizes. Void in Alaska, Delaware, Hawaii, Maryland, New Jersey and Virginia, outside the continental United States and where prohibited by law. This Game is subject to all applicable federal, state and local laws.
- General: By participating, participants agree (a) to be bound by these Official Rules and the decisions of the Sponsor and judges, which are final and binding in all matters; (b) to the use by Sponsor and its designees of their names, cities and states of residence and likenesses for advertising, promotional and other purposes in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law; and (c) to release, discharge and hold harmless Sponsor, Marketing Drive, LLC, PSG, Rivet, participating sponsors, and their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising and promotion agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this Game, and the respective directors, officers, agents and employees of the foregoing (collectively, the "Released Parties") from any liability, claims, losses and damages arising out of or relating to their participation in this Game and the acceptance, use, misuse or possession of any prize received (including any travel or activity related thereto). Released Parties are not responsible for lost, late, stolen, damaged, garbled, inaccurate, incomplete, misaddressed, illegible, mutilated, postage due, undelivered, delayed or misdirected mail, undeliverable e-mail addresses, game code requests, phone calls, prize claims, entries or game plays or for errors, omissions, interruptions, deletions, defects, phone transmissions or delayed telephone lines or in operations or transmission of information, in each case whether arising by the way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines, or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, Released Parties are not responsible for electronic communications, which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. Game plays will be declared made by the authorized account holder of the e-mail address submitted at the time of participation and such individual must be eligible according to these rules. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Participant may be requested to provide Sponsor with proof that the participant is the authorized e-mail account holder of the e-mail address associated with the account/submission. Proof of submitting games plays and/or mailing game code requests will not be deemed to be proof of receipt by Sponsor. Released Parties are not responsible for any other errors, malfunctions or problems of any kind, whether computer, network, printing, seeding, typographical, technical, telephonic, human or otherwise, relating to or in connection with this Game, including, without limitation, errors, malfunctions or problems which may occur in connection with the administration of the Game, the announcement of the prizes, the processing of game plays, game code requests or prize claims or in any Game-related materials. The use of automated software or computer programs to register or to play the Game is prohibited and any individual who uses or attempts to use such methods to register will be disqualified and all his/her game plays/entries will be void. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Game. Sponsor reserves the right, at its sole discretion, to modify or terminate this Game, should any virus, bug, technical failures, unauthorized human intervention or other causes corrupt or affect the administration, security, fairness or proper conduct of the Game, and at its discretion, conduct the Grand Prize drawing and award any unclaimed Instant Win Prizes at random from among all eligible, non-suspect game plays received up to time of such action for this Game. In the event of any such cancellation, termination or suspension, a notice will be posted on www.raceoutawinner.com. Sponsor reserves the right, at its sole discretion, to disqualify any entrant from this Game or any other promotion conducted now or in the future by Sponsor or any of its affiliates if his or her fraud or misconduct affects the integrity of the Game or who is otherwise in violation of these Official Rules, as determined by Sponsor in its sole discretion, and void all associated game plays. You are not a winner until your eligibility and game play have been verified, and it is determined that you have complied with all terms of these Official Rules. Game codes are void if they contain any printing, mechanical, seeding, typographical or other errors, or if they have been tampered with or obtained other than through authorized channels. In no event will more prizes be awarded than set forth herein. If computer, printing, mechanical, seeding, typographical or other errors result in more valid prize claims for any prize level than the number stated herein, Sponsor reserves the right, at its sole discretion, to award the stated number of prizes for that level in a random drawing from among all eligible, non-suspect and valid prize claims received for such level. All materials submitted in connection with this Game become the property of Sponsor and will not be returned. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
